Obtaining a license for a protection and security company is based on several obligations, including the registration of the name of the company and the logo used at the State Office for Inventions and Trademarks, according to Art. 19 (3) letter. c) of the Law no. 333/2003, respectively:
“(3) In order to obtain an operating license, the following conditions must be met:
- c) the presentation of the registration proof with the name of the company and of the distinctive signs registered at the State Office for Inventions and Trademarks”.
Therefore, when the license is requested from the competent entity, namely from the Police Inspectorate in the area where the security company is located, the associates must also present a trademark registration certificate issued by OSIM, to prove the registration of the trademark.
It is very important to remember that the trademark must be distinctive, non-descriptive, and contain a color logo.
Moreover, Article 3 (1) of GD 935/2007 requires that the equipment of security and protection officers contain the name and logo of the security company approved by OSIM:
“Article 3
- The jacket, vest, protective blouse, quilted or fur shorts, sweatshirt, skirt, leather coat, shirt-blouse, coverall, overalls are clearly visible on the back with the name and logo of the security and protection company, approved by the State Office for Inventions and Trademarks.
- The emblem of the security and protection company is applied to the helmet.”
There are many trademarks rejected by OSIM due to lack of distinctiveness or because all the conditions for trademark registration have not been met, the best solution being to check the availability of the trademark before registration and to find an intellectual property adviser who can guide you and assists in the trademark registration process at OSIM.
