Por ejemplo, una idea con respecto a un libro no est\u00e1 protegida, pero las palabras escritas s\u00ed, representan propiedad intelectual. Si sabe c\u00f3mo proteger su idea, ahorra mucho tiempo y dinero.<\/p>\n<p>El derecho de propiedad intelectual puede proteger solamente <strong>el desarrollo de una idea y del modo de expresi\u00f3n de la misma<\/strong>. De esta manera, ciertos aspectos del derecho de propiedad intelectual, como los derechos de autor, las patentes, los dibujos o los secretos comerciales, pueden ofrecerle protecci\u00f3n.<\/p>\n<p>Tener la protecci\u00f3n de la propiedad intelectual le ayuda evitar que el nombre de sus productos o de sus marcas, los inventos, el dise\u00f1o o el aspecto de sus productos, las cosas que escribe, hace o produce, sean copiados o utilizados.<\/p>\n<p>Los derechos de autor, las patentes, los dibujos industriales, las marcas comerciales, todos constituyen tipos de propiedad intelectual que pueden otorgarle protecci\u00f3n autom\u00e1ticamente o por su registro.<\/p>\n<h4><strong>Derechos de autor<\/strong><\/h4>\n<p>Los derechos de autor protegen las<strong> ideas expresadas, concretadas<\/strong>. Estos ofrecen al titular derechos exclusivos de explotar su trabajo original y de utilizarles como desea. Pero para encuadrarse en la protecci\u00f3n de los derechos de autor, el trabajo tiene que ser original. El derecho de autor <strong>no impide a alguien utilizar su idea y expresarla de manera distinta<\/strong>.<\/p>\n<p><strong>Patentes<\/strong><\/p>\n<p>Una patente protege los inventos relativos a: productos, m\u00e9todos, aparatos, materiales o procesos. Las patentes ofrecen al titular <strong>derechos legales de explotar comercialmente el invento<\/strong>. La elegibilidad para la protecci\u00f3n de la patente depende del car\u00e1cter novedoso del invento. A diferencia de los derechos de autor, es <strong>necesario solicitar el registro y la concesi\u00f3n de una patente<\/strong> para obtener derechos. Este proceso suele ser complejo y bastante costoso. Sin embargo, la protecci\u00f3n mediante patente concede un monopolio sobre este invento de hasta 20 a\u00f1os.<\/p>\n<h4 class=\"LC20lb\">Dibujos y modelos industriales<\/h4>\n<p>El registro de los<strong> dibujos industriales<\/strong> protege las caracter\u00edsticas de un producto que le conceden un aspecto \u00fanico. Por ejemplo, el dise\u00f1o de una botella de perfume distintivo desde el punto de vista est\u00e9tico. Al igual que las patentes, el dibujo tiene que <strong>registrarse<\/strong>, y el dise\u00f1o debe cumplir los caracteres <strong>novedosos y distintivos<\/strong>. Por consiguiente, no puede ser id\u00e9ntico a otro patr\u00f3n de dibujo o similar en su conjunto.<\/p>\n<h4><strong>Secreto comercial<\/strong><\/h4>\n<p>Cualquier informaci\u00f3n comercial secreta que confiere a un negocio una ventaja con respecto a otro es un secreto comercial. Los secretos comerciales incluyen m\u00e9todos de fabricaci\u00f3n, f\u00f3rmulas para productos y estrategias empresariales. La principal ventaja de un secreto comercial es el hecho que, a diferencia de otras protecciones, protege m\u00e1s bien <strong>una idea y una informaci\u00f3n que una expresi\u00f3n de la idea<\/strong>. Asimismo, <strong>no hay l\u00edmite de tiempo<\/strong> para la protecci\u00f3n; esta dura mientras se mantiene la confidencialidad.<\/p>\n<p>\u00bfQu\u00e9 hay que hacer para mantenerlo? Celebraci\u00f3n de <strong>contratos adecuados<\/strong>. Por ejemplo, acuerdos de confidencialidad o cl\u00e1usulas espec\u00edficas de los contratos de trabajo o de servicios.<\/p>\n<p>En conclusi\u00f3n, las simples ideas no pueden ser protegidas, pero la transformaci\u00f3n de la idea en algo tangible puede ofrecer protecci\u00f3n especialmente porque la expresi\u00f3n de la idea permite la protecci\u00f3n autom\u00e1tica de los derechos de autor.
